Relationship to Other Documents

This standalone Limitation of Liability document restates, for clarity and easy reference, the liability limitations that also appear in Terms of Service §11 and EULA §9. It does not create new or additional limitations beyond those documents; if any inconsistency arises, the Terms of Service governs for use of the Service generally, and the EULA governs for software licensing terms specifically.

No Liability for Network Performance

Because Donnas-Bandwidth-Booster™ operates on top of third-party wireless and internet infrastructure it does not own or control (see Disclaimer), Dominus Energy Group LLC is not liable for losses arising from network unavailability, degraded performance, dropped connections, or carrier or internet service provider outages, regardless of whether the Service was active at the time.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOMINUS ENERGY GROUP LLC, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOMINUS ENERGY GROUP LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

These caps do not limit liability for gross negligence, willful misconduct, or any other liability that cannot be limited or excluded under applicable law.

Essential Purpose

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law, and the limitations above apply only to the extent consistent with applicable law.

Basis of the Bargain

You acknowledge that Dominus Energy Group LLC has set its pricing, in part, in reliance on the limitations of liability set forth in this document and in the Terms of Service and EULA, and that these limitations are an essential basis of the agreement between you and us.
