1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of Donnas-Bandwidth-Booster™ (the "Service"), including the Android and iOS applications, the companion website, and the Executive Management Console™ (collectively, the "Platform"), provided by Dominus Energy Group LLC ("Dominus Energy Group," "we," "us," or "our").

By creating an account, installing the application, or otherwise using the Service, you agree to be bound by these Terms, our Privacy Policy, and our End User License Agreement. If you do not agree, do not use the Service.

2. Eligibility

You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, to use the Service. By using the Service you represent that you meet this requirement.

3. Description of the Service

Donnas-Bandwidth-Booster™ is an AI-assisted network optimization service that monitors connection quality metrics (latency, jitter, packet loss, throughput, transport type) on a registered device and recommends or applies network path adjustments (for example, preferring Wi-Fi over cellular, or initiating failover) to improve connectivity. Core capabilities include the Adaptive Connectivity Engine™, MeshLink™, Network Check™, the AI Network Health Score™, Intelligent Diagnostics™, Real-Time Connection Monitoring™, offline caching, automatic retry and synchronization, and — for eligible plans — TeamSync™. The Service does not guarantee any specific network performance outcome — actual results depend on factors outside our control, including your carrier, network hardware, and physical environment. 4. Accounts

• You are responsible for maintaining the confidentiality of your

credentials and for all activity under your account.

• You must provide accurate registration information and keep it current.
• You must notify us promptly of any unauthorized use of your account.
• We may suspend or terminate accounts that violate these Terms or our

Acceptable Use Policy.

5. Subscription Plans and Fees

The Service is offered under four plan tiers — Free, Basic Premium, Professional, and Business & Enterprise — with different feature sets and device limits, as described in Subscription Terms and in-app at the time of purchase. The Adaptive Connectivity Engine™ is included at no cost on every tier, including Free. Fees, billing cadence, and payment terms are governed by our Billing & Payment Policy, and cancellation terms are governed by our Refund & Cancellation Policy.

6. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

The Service, including its source code, designs, graphics, documentation, trademarks, and underlying technology, is the proprietary property of Dominus Energy Group LLC and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except the limited license described in the End User License Agreement.

8. Privacy and Data Processing

Our collection, use, and retention of information is described in our Privacy Policy and Data Retention Policy. By using the Service you consent to the data processing described there.

9. Third-Party Services and Open Source Software

The Service incorporates open-source software components, each subject to its own license terms — see our Open Source Software Notices. The Service also relies on a limited set of third-party operated services — see our Third-Party Services Disclosure.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY NETWORK PERFORMANCE IMPROVEMENT WILL RESULT FROM ITS USE. 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMINUS ENERGY GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, this limitation applies only to the extent consistent with applicable law. 12. Indemnification

You agree to indemnify and hold harmless Dominus Energy Group LLC from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

13. Termination

You may stop using the Service and delete your account at any time — see our Account Deletion Policy. We may suspend or terminate your access for violation of these Terms, non-payment of applicable fees, or as required by law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be presented to you for re-acceptance the next time you use the Service, and a version history will be maintained. Continued use of the Service after a new version takes effect constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
