End User License Agreement (EULA)
This End User License Agreement ("Agreement") is between you and Dominus Energy Group LLC ("Licensor") and governs your installation and use of the Donnas-Bandwidth-Booster™ Android and iOS applications (the "Software"). By installing, accessing, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.
1. License Grant
Subject to your compliance with this Agreement, our Terms of Service, and our Acceptable Use Policy, and subject to your plan tier's entitlements, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, solely for your personal or internal business use, for as long as your account remains in good standing.
2. License Restrictions
You may not, and may not permit any third party to:
- Copy, modify, or create derivative works of the Software.
- Reverse engineer, decompile, or disassemble the Software, except to the
extent such restriction is prohibited by applicable law.
- Rent, lease, lend, sell, sublicense, or otherwise transfer the Software
to any third party.
- Remove or alter any proprietary notice, trademark, or label on the
Software.
- Use the Software to build a competing product or service.
- Circumvent any license-tier restriction or device limit.
3. Ownership
The Software is licensed, not sold. Licensor and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. See our Intellectual Property Notice and Intellectual Property Policy. No rights are granted to you other than those expressly set out in this Agreement.
4. Third-Party and Open Source Components
The Software includes third-party open-source components, each governed by its own license — see our Open Source Software Notices. Those licenses control your rights with respect to the applicable components to the extent they conflict with this Agreement.
5. Updates
Licensor may release updates, patches, or new versions of the Software. Some updates may be required for continued use of the Service. This Agreement applies to all updates unless a separate license is provided with the update.
6. Data Collection
Your use of the Software is subject to our Privacy Policy.
7. Term and Termination
This Agreement is effective until terminated. It terminates automatically if you fail to comply with any term. Upon termination, you must stop using the Software and, if requested, uninstall it from all devices. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability) will survive.
8. Disclaimer of Warranty
THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE. See our Disclaimer for specific claims we do not make about the Software.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, this limitation applies only to the extent consistent with applicable law. 10. Export Compliance
You agree to comply with all applicable export and re-export control laws and regulations in your use of the Software. Dominus Energy Group LLC is in the process of completing the applicable export-compliance classification for the Software; this section will be updated to reflect the finalized classification once that process is complete.
11. Governing Law
This Agreement is governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, consistent with the Terms of Service.
12. Acceptance and Version History
Acceptance of this Agreement is recorded against its version number at the time of acceptance. If we materially change this Agreement, you will be asked to accept the updated version before continuing to use the Software.
